Welcome to BrandOps. These Terms of Service ("Terms") govern your access to and use of the BrandOps multi-brand content planning and governance platform (the "Service") operated by BrandOps ("we", "our", or "us").

BrandOps is a content governance and scheduling intelligence system designed for solo founders managing multiple brands. Our Service provides:

  • Multi-brand content planning and organization
  • Content pillar enforcement and rules
  • Automatic posting calendar generation
  • Social media platform integrations (Meta, LinkedIn, X)
  • Content publishing to connected social media accounts
  • Engagement metrics tracking and analytics
  • Content export capabilities

3. Account Registration and Security

3.1 Account Creation

To use our Service, you must register for an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to:

  • Use a strong, unique password
  • Notify us immediately of any unauthorized access or security breach
  • Not share your account credentials with third parties
  • Be responsible for all actions taken under your account

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem necessary to protect our Service and users.

4. User Conduct and Content

4.1 Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Impersonate any person or entity or misrepresent your affiliation
  • Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, or violates third-party rights
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service

4.2 User Content

You retain ownership of all content you create, upload, or post through our Service ("User Content"). By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving our Service.

4.3 Content Responsibility

You are solely responsible for your User Content and any content you publish to social media platforms through our Service. You represent and warrant that:

  • You own or have the necessary rights to use and authorize the use of your content
  • Your content does not violate any third-party rights (copyright, trademark, privacy, etc.)
  • Your content complies with all applicable laws and platform-specific terms of service

5. Social Media Integrations

5.1 OAuth Connections

Our Service allows you to connect social media accounts (Facebook, Instagram, Threads, LinkedIn, X) through OAuth 2.0. When you connect an account:

  • You authorize us to access your account according to the permissions you grant
  • We store encrypted access tokens to facilitate Service functionality
  • You can disconnect your account at any time
  • You remain responsible for compliance with each platform's terms of service

5.2 Publishing Content

When you use our Service to publish content to social media platforms:

  • You explicitly authorize each publishing action
  • You are responsible for ensuring content complies with platform rules and guidelines
  • We are not responsible for content removal, account suspension, or other actions taken by social media platforms
  • Publishing features may be subject to platform approval and availability

5.3 Platform Terms

Your use of social media platforms through our Service is also governed by each platform's terms of service. We are not responsible for changes to platform APIs, terms, or policies that may affect Service functionality.

6. Intellectual Property

6.1 Service Ownership

The Service, including its original content, features, functionality, design, and software, is owned by BrandOps and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

7. Payment and Subscription

7.1 Subscription Plans

Certain features of our Service may be available only through paid subscription plans. We reserve the right to change subscription fees at any time with reasonable notice.

7.2 Payment Terms

7.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until the end of the billing period.

8. Service Availability and Modifications

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. For detailed availability commitments, please see our Service Level Agreement.

8.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANDOPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

9.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless BrandOps, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

11.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in fraudulent or illegal activity.

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account data, though some information may be retained for legal or legitimate business purposes. For more information, see ourData Retention Policy.

12. Governing Law and Dispute Resolution
